CORNWALL INLAND WETLANDS AND WATERCOURSES AGENCY
MINUTES OF THE
FEBRUARY 3, 2011 SPECIAL MEETING - CORNWALL TOWN HALL

Present: Regular members Roger Kane, Celia Senzer, William Hurlburt, Alternate members Doc Simont and Andrew MacDavid (in 7:35PM) and Land use staff Karen Griswold Nelson.
Absent: Regular members D. Stevenson Hedden and Adam Fischer.

Secretary Roger Kane called the meeting to order at 7:30 PM in the Cornwall Town Hall with a quorum established. Mr. Simont was seated for regular member D. Stevenson Hedden and Mr. MacDavid was seated for regular member Adam Fischer upon his arrival.

APPROVAL OF MINUTES: January special meeting.
Motion made by Mr. Hurlburt, seconded by Mr. Simont to approve the minutes of the January meeting as presented: unanimously approved.
Mr. MacDavid in 7:35PM.

PENDING APPLICATIONS:
App #544 – Allied Engineering Associates applicant/Stephen Hart owner – Construction of a single family residence on land with activities uphill of regulated areas – 10.25 acre lot (Assessors map – HO3-03-20) with access from Railroad Street. Accepted at the January meeting based on the receipt of fee.
No one was in attendance to represent the application. Griswold Nelson advised the Commission that verbal conversations with Mr. Hart that day indicated that the review fee check requested was being mailed that day. No action taken.

App #545 – Reginald Auchincloss applicant-owner – After-the-fact activities within regulated areas including site clearing and woods management associated with the renovation of an existing single family residence – 8 Town Street.
No one was in attendance to represent the application. With agreement that the site was inaccessible due to the snow cover and difficult to assess
Motion made by Mr. Hurlburt, seconded by Mr. Simont to table App #545: unanimously approved.

App #546 – Cornwall Housing Corporation applicant/owner – Construction of a ten unit elderly affordable housing project – report required as part a Special Permit application to the P&Z Commission – no disturbance with wetlands soils – Kent Road.

February 1, 2011 correspondence from the State of Connecticut Department of Transportation to Brian Neff – entitled Transmittal Permits.
February 2, 2011 correspondence from Brian Neff to Douglas Humes, DOT District permit Inspector referencing a Proposed driveway entrance Plan, revised in response to comments.
Margaret Cooley, CHC president and Brian Neff, engineering representative for the applicant were in attendance to address the application.
Griswold Nelson stated that the revised plans (as referenced above and submitted that day) had been hand delivered to Sean Hayden at the Northwest Conservation District that afternoon for review of the E&S controls and overall site construction sequence, noting that the plans stated “additional erosion and sedimentation measures may be required at the discretion of the town wetlands enforcement officer or the design engineer based upon site conditions”.
Mr. Neff addressed the revised plans submitted, noting additional drainage details added on the front of the site. Mr. Neff re-addressed the areas of wetlands on the site upgradient of the proposed grading for the construction of the building, reiterating that the plans as prepared proposed no additional drainage to the wetlands and proposed no activities within wetlands soils. Mr. Neff addressed the storm water infiltration system proposed downhill on the site in response to the DOT correspondence (as referenced). In response, Mr. Kane stated that the information and revised plans submitted addressed some of his comments made at the January meeting.
Griswold Nelson pointed that the “erosion and sedimentation control plan” was also within the purview of the Planning & Zoning Commission and would be addressed as part of the special exception permit being heard in public hearing in the upcoming week. Griswold Nelson noted that town planner Thomas McGowan, in his initial review of the application for the P&Z special permit supported the review of the E&S control plan by Northwest Conservation District.
Hearing no other questions or comments from the Commission:
Motion made by Mr. Simont, seconded by Mr. Hurlburt, to pass on the report of App# 546 to the Planning & Zoning Commission with the finding of no outstanding issues, and note made that while the Inland Wetland Agency did not have the final review of the E&S control plan, that the jurisdiction was being passed on the P&Z for the final say; motion unanimously approved.

NEW APPLICATIONS. None.

PENDING ENFORCEMENT ACTIONS:
SHOW CAUSE HEARING: Notice of Violation – Cease and Correct - Adam and Charlotte S. VanDoren – 54 Bradford Road – Regulated activities including - Removal and deposition of material within wetlands soils, alteration of wetlands soil, activities within a watercourse, and the possible crossing of a watercourse without permits.

NOTICE OF VIOLATION - CORRECT AND RESTORE - George and Karen Yancopoulos -71 and 73 Popple Swamp Road – Assessors Map CO6-02-10 - Lack of proper maintenance within regulated areas, including a waterbody and watercourse, resulting in the discharge of water over a town road and flooding of downstream and abutting properties

INLAND WETLANDS OFFICER REPORT.
Griswold Nelson reported discussions with town attorney Perley Grimes regarding revisions to the regulations and other questions raised by chairman Steve Hedden and her recommendation that Attorney Grimes come to a workshop meeting with the commission so as better vet the questions and concerns being posed. With note made that several members would not be available to come to March’s meeting, Griswold Nelson was to schedule a special meeting in March based on the attendance issues raised.
