MINUTES OF A SPECIAL MEETING OF THE CORNWALL

ZONING BOARD OF APPEALS HELD ON JUNE 14, 2006



A Special Meeting of the Cornwall Zoning Board of Appeals was held at 8:00 on Wednesday, June 14, 2006 in the Cornwall Town Hall. Present were: Anne Chamberlain, Janet Gold, Hanna Grossman, Ann Schillinger, Nancy Calhoun and Lynn Fowler. Also present was Land Use Clerk Colin Gold.


The meeting adjourned to the Public Hearing at 8:05 and reconvened at 8:15 pm. .



PUBLIC HEARING


Appeal #309 Paul L. Cornell, Trustee, Ballyhack Road (James Vanicky, Applicant)

To vary section 4.1 (Buildable Area Regulations)


Peter Ebersoll presented the appeal. He reminded the Board of the facts of the application and why it was necessary to come before them. John Goodrich, the property owner was present and told the Board that he intended to keep the rest of the land as forest and designate it as 490 land (Public Act 490). Peter also reminded the Board that their decision would not create any sort of precedent for future applications. Anne Schillinger asked about the location of the intermittent stream on the map. It was pointed out. Nancy Calhoun wanted to be sure that the land would not be developed and that it would definitely be placed in 490. Mr. Goodrich assured the Board that as long as he lived, there would be no development on the remaining acreage of the parcel. Some questions arose about the existing approved building sites which had been dismissed as unusable. Mr. Goodrich reiterated that he had a history of conserving land in town. Janet Gold declared the Public Hearing closed.

OLD BUSINESS


Appeal #309 Paul L. Cornell, Trustee, Ballyhack Road (James Vanicky, Applicant)

To vary section 4.1 (Buildable Area Regulations)


Nancy Calhoun asked whether, as an alternate, she was permitted to vote since one of the full members of the Board was not present. Janet designated her to vote for Joanne Wojtusiak.


On a motion to grant the appeal, the vote was unanimously in favor with the following reasons given in support of the decision:


1. The subdivision does not significantly change the character of the neighborhood.


2. The regulations presented a hardship to Mr. Vanicky.


3. There is a minute amount of the buildable area that does not meet buildable area regulations.



COMMUNICATIONS


Hanna Grossman reminded the Board that no precedent can be set in approving or denying appeals.


Ann Schillinger recommended setting meeting dates in the future that Karl could attend; these being Wednesdays or Thursdays. Janet asked Colin whether meeting dates this year could be changed. Colin said that he would find out and report back to her.
