MINUTES OF THE

REGULAR MEETING MARCH 4, 2008 CORNWALL TOWN OFFICE BUILDING


Present: Regular members D. Stevenson Hedden, Adam Fischer, William Hurlburt and Celia Senzer.

Absent: Regular member Doc Simont and alternates Roger Kane and Andrew MacDavid.


Chairman Hedden called the meeting to order at 7:30PM in Cornwall Town Hall with a quorum established.


APPROVAL OF MINUTES: February regular meeting

Motion Mr. Hurlburt, second Mr. Fischer to approve the minutes of the February regular meeting as presented: approved Mr.’s Hedden, Hurlburt and Fischer.


PENDING APPLICATIONS:

App. 509 – Ralph and Thalia Scoville owners/Yelping Hill Assoc. applicant – Construction of a proposed parking area near Cream Hill Lake – off Town Street. Accepted at the February 4th regular meeting.

Brian Skarstad and Jeremy Brecher of Yelping Hill Assoc. and Josh Tyson, contractor for the project represented the application.

In response to the plans presented, Mr. Hedden, noting that he had no issues with the project itself, recommended that a catch basin with an outflow pipe so as to divert surface water be considered and asked that the perimeter of the parking area be staked.

In response, Mr. Tyson addressed the consideration of a 2’x 2’ catch basin with a 12” pipe so as to make the surface water go back to the brook and not the lake with agreement that such a design, as reviewed and approved by an engineering consultant, be prepared.. It was suggested that elevations be shot and made part of the design as well.

Mr. Skarstad addressed the history of the site and the proposed transfer of land and lot line adjustment between the Scoville’s and Yelping Hill as relating to the proposed changes to the existing parking area.


Motion Mr. Hurlburt, second Mr. Fischer to table further discussion of App. 509 – Ralph and Thalia Scoville owners/Yelping Hill Assoc. applicant – Construction of a proposed parking area near Cream Hill Lake – off Town Street to the April regularly scheduled meeting. NEW APPLICATIONS:

App 511 – Einar Lindholm applicant/owner– Construction of a single family residence with activities within regulated areas– report to Planning and Zoning for subdivision approval.

Einar Lindholm represented the application.

The commission reviewed the plans presented with questions raised as to the new driveway configuration proposed and the need for paving the areas of the driveway exceeding 10% grade. Based on the need for additional information including the feasibility of the curb cut as shown and the final details for the driveway:




Motion Mr. Hurlburt, second Mrs. Senzer to accept App 511 – Einar Lindholm applicant/owner– Construction of a single family residence with activities within regulated areas– report to Planning and Zoning for subdivision approval and to table further discussion and decision on the application to the April regularly scheduled meeting. INLAND WETLANDS OFFICER REPORT.

January 31, 2008 correspondence from Hrica Associates LLC, Litchfield, CT constituting a conformation of compliance for App# 493/494 Karen Greenberg – 6 Day and Flat Rocks Road, was reviewed and made part of the record.

February 8, 2008 correspondence from Hrica Associates LLC, Litchfield CT constituting a flooding analysis of the existing town culvert conveying storm water under Flat Rocks Road onto the Greenberg property (as requested as part of App# 493/494 /Karen Greenberg – 6 Day and Flat Rocks Road) was reviewed and made part of record.

Ms. Griswold Nelson advised the commission that work approved as part of App# 477 Colts Foot Valley – Valley Road had been completed without any issues.

Ms. Griswold Nelson addressed the ongoing process to address issues at the 70 Kent Road site under a Cease and Correct order.
