MINUTES OF THE

REGULAR MEETING JULY 1, 2008 CORNWALL TOWN OFFICE BUILDING


Present: Regular members D. Stevenson Hedden, Adam Fischer, William Hurlburt, Celia Senzer, alternates Roger Kane and Andrew MacDavid and Land Use staff Karen Griswold Nelson

Absent: Regular member Doc Simont.


Chairman Hedden called the meeting to order at 8:00PM in Cornwall Town Hall with a quorum established. Alternate Roger Kane was seated for regular member Doc Simont.


Motion Mr. Kane, second Mr. MacDavid to amend the agenda to add Application #513 - Kristal Porter dba Shoreline Weed Control applicant/Art Schor and Emmanuel Stern owners – Petition for a declaratory ruling for the maintenance of a historic pond – Flat Rocks Road to the agenda under New Applications; unanimously approved.


APPROVAL OF MINUTES: June regular meeting

Motion Mr. Kane, second Mr. MacDavid to approve the minutes of the June meeting with the clarification of Mr. Kane’s input as a commission member not an engineer: unanimously approved.


PENDING APPLICATIONS:

App 512 – H. R. DePolo architect – applicant/owner – Site activities associated with the construction of a single family residence near Mill Brook – Corner of Dibble Hill Road and Route 128.

June 30, 2008 correspondence from First Selectman Gordon Ridgway regarding driveway entry and feasibility from the town road.

June 10, 2008 correspondence from H R. DePolo.

June 10, 2008 correspondence from Michael Root, Root Tree Service regarding tree removal.

June 6, 2008 correspondence from Patrick Redmond regarding digging ground for piers.

After review of the information submitted and made part of the file and with input from Mr. Hedden that he had personally talked to the building official regarding the proposed construction and that his concerns had been satisfied

Motion Mr. Hedden, second Mr. MacDavid to approve App 512 – H. R. DePolo architect – applicant/owner – Site activities associated with the construction of a single family residence near Mill Brook – Corner of Dibble Hill Road and Route 128 as per the oral and written testimony of the record and the site plans submitted, “Erosion and sediment Control Plan and Construction sequence – DePolo property SE Corner Dibble Hill Route and Route 128, West Cornwall, dated May 5, 2008 and “Subsurface Sewage Disposal Design DePolo property, Southeast Corner Dibble Hill Road and Route 128, West Cornwall, dated February 5, 2008 revised to 4/1/2008 with the following conditions: .

  1. The project engineer is to provide project supervision, at the landowner’s expense, sufficient to maintain control of the entire project.

  2. The project engineer is to provide project supervision and assume the responsibility for all erosion and sedimentation controls as the expense of the landowner. The project engineer can assign maintenance of the erosion and sedimentation controls to others but shall maintain responsibility for the maintenance of same.


  1. The project engineer is to stake out the silt fence and supervise the installation of the silt fence.

  2. The plans shall be modified to show the addition of a 15” culvert pipe under the driveway as per the recommendation of the Board of Selectman.


As part of the approval, the Inland wetland Enforcement Officer was to be notified prior to the start of any construction on the site.

Prior to action on the motion, the applicant and his representatives were cautioned (“let there be no misunderstanding” – Hedden) that the application as approved only covered the work described in the application in terms of the removal and deposition of material for the siting of the piers for the house, and the activities as shown for the construction of the septic system and the driveway and that no paths, walkways, removal or deposition of material or removal or addition of any vegetation outside of the area of work as shown on the plans were permitted, nor was there approval for any clear cutting of the slope between the structure and the brook and that any such activity as listed would require the submission of another application.

Motion unanimously approved.


NEW APPLICATIONS:

Application #513 - Kristal Porter dba Shoreline Weed Control applicant/Art Schor and Emmanuel Stern owners – Petition for a declaratory ruling for the maintenance of a historic pond – Flat Rocks Road.

The commission reviewed the material presented by staff with direction given that staff was to direct the applicant to tidy up the signature page, flag the areas designated as the spoils areas, provide an erosion and sedimentation control plan for the spoils areas specific to the site and address the method of transportation of the spoils from the pond to the de-watering area. Staff was to contact the downstream reservoir personnel and DEP fisheries division regarding the pending application.

INLAND WETLANDS OFFICER REPORT.

Ms. Griswold Nelson advised the commission of conversations with Sam Waterston regarding the clearing of agricultural land on his Great Hollow Road property and his agreement that erosion and sedimentation controls would be installed when needed as part of the clearing.

Griswold Nelson advised the commission of phone calls received from the Rogala’s from Johnson Road regarding their Johnson Road land being impacted by beavers on abutting property with agreement to follow up on the matter with the appropriate parties to remedy the matter.
