MINUTES OF A REGULAR MEETING OF THE CORNWALL INLAND WETLANDS AND WATERCOURSES AGENCY HELD ON AUGUST 1, 2006
A Regular Meeting of the Cornwall Inland Wetlands and Watercourses Agency was held at 8:00 pm on Tuesday, August 1, at the Cornwall Town Hall. Present were: Chairman D. Stevenson Hedden, presiding; members, Doc Simont, Celia Senzer, and Roger Kane, and Alternate Andrew MacDavid. Also present were Land Use Administrator Karl Nilsen and Clerk Colin Gold.
Andrew was designated to vote.
The Minutes of the Regular Meeting of July 5, 2006 were approved as circulated.
OLD BUSINESS
Show-Cause Hearing Cooks-Randall
Neither of the applicants nor their representatives were present. Karl Nilsen informed the Agency that there were two logical directions in which they could go: legal action or another Show-Cause Hearing. Doc Simont, recently appointed, asked what the history of the issue was. Karl ran it through for him. Karl said that reclamation was needed soon, but that a timeframe should not be put on the process. Steve Hedden said that the applicants will be required to submit a permit for the regulated activity and ordered to remove the illegal driveway and restore the wetlands, with possible legal action looming, if not carried out precipitously. Celia Senzer made the motion and Doc seconded. It passed unanimously. Karl added that a copy of the next letter for the Cooks-Randall Show-Cause Hearing should be sent to Steve in advance.
Update from Karl re: Curt Hanson, Cornwall Hollow Road
Karl informed the Agency that he had spoken with the DEP and that they had said it was illegal to remove the beaver dam that had been constructed on top of Mr. Hanson’s dam. He said that he would speak with Bill Hurlburt to find out what material was there before Mr. Hanson built the dam.

Application #471 J. Van Doren, Bradford Road
To remove silt from pond
Steve summarized the letter from the engineer for the project. He said that the dam could hold, but that he would like to have the statement signed and sealed by the engineer, as well as a construction procedure. Roger Kane asked whether there should be a performance bond set. Steve said that there would be time to think about this since this was just the first month the application had been in receipt. Karl said that the bond could be made as a condition to the approval. Doc made a motion to table the application until the next scheduled meeting. Steve added that he would like to have an Erosion and Sedimentation Control Plan and specifics on the volume of removed material. Celia seconded and it carried unanimously.
COMMUNICATIONS
Karl told the Commission that the Vanicky application that they had approved in May had been slightly amended, but the changes would not affect wetlands in any way. The Agency then discussed the notice regarding commercial logging activity on the Kent line. Karl said that he would talk to the logger about whether the activity will affect the watercourse in Cornwall. Lastly, Colin informed the Agency that there had been several calls from concerned citizens about the projected use of pesticide at Cream Hill Lake. Karl said that all usage of pesticides is out of the Town’s jurisdiction. The DEP grants requests for chemical use by licensed contractors. He did say that the Agency could ask the DEP to furnish to them the written permit regarding the proposed use.
