MINUTES OF THE
REGULAR MEETING AUGUST 5, 2008 CORNWALL TOWN OFFICE BUILDING
Present: Regular members D. Stevenson Hedden, Doc Simont, alternates Roger Kane and Land Use staff Karen Griswold Nelson
Absent: Regular member Adam Fischer, William Hurlburt, Celia Senzer and Andrew MacDavid.
Chairman Hedden called the meeting to order at 8:00PM in Cornwall Town Hall with a quorum established. Alternate Roger Kane was seated for regular member William Hurlburt.
APPROVAL OF MINUTES: July regular meeting
Motion Mr. Kane, second Mr. Hedden to approve the minutes of the July meeting as presented: unanimously approved.
PENDING APPLICATIONS:
App #513 - Kristal Porter dba Shoreline Weed Control applicant/Art Schor and Emmanuel Stern owners – Petition for a declaratory ruling for the maintenance of a historic pond – Flat Rocks Road. (Accepted at the July meeting)
Art Schor and Emmanuel Stern co-owners were in attendance to represent the application.
Based on new written information supplied that satisfied the concerns of the commission as reflected in the July meeting, it was stated that the one remaining concern to address was the location of the actual site for the disposition of the vegetation to be removed from the pond. Mr. Kane stated that his site visit showed that the area was well marked out. With agreement that all concerns had been satisfied:
Motion Mr. Kane, second Mr. Simont, to approve App #513 - Kristal Porter dba Shoreline Weed Control applicant/Art Schor and Emmanuel Stern owners – Petition for a declaratory ruling for the maintenance of a historic pond – Flat Rocks Road as per the oral and written testimony of the applicant/owners.
As part of the approval, the Inland wetland Enforcement Officer was to be notified prior to the start of any work on the site to ensure that the erosion and sedimentation controls as specified in the plans were in place prior to the start of work.
Motion unanimously approved.
NEW APPLICATIONS:
App # 514 - Debra Tyler applicant/Rawls/Jones/Bedell et all owners – Petition for a declaratory ruling for improvements in regulated areas for existing animal trailways as per project engineered by NRCS as part of an EQUIP grant – Popple Swamp Road.
Debra Tyler applicant was in attendance to represent the application.
Deeming the information and proposal submitted as extensive and adequately detailed, the commission agreed that their concerns had been satisfied.
Motion Mr. Simont, second Mr. Kane, to determine that App # 514 - Debra Tyler applicant/Rawls/Jones/Bedell et all owners – Petition for a declaratory ruling for improvements in regulated areas for existing animal trailways as per project engineered by NRCS as part of an EQUIP grant – Popple Swamp Road constituted a “Use as of right” as per Section 4.1a of the Cornwall Inland Wetlands and Watercourse Regulations”.

Motion unanimously approved.

Ms. Griswold Nelson advised the commission that work had commenced on the Furnace Brook Farms site.
