MINUTES OF THE
REGULAR MEETING SEPTEMBER 1, 2009 CORNWALL TOWN OFFICE BUILDING
Present: Regular members D. Stevenson Hedden, William Hurlburt, Celia Senzer and alternates Roger Kane and Andrew MacDavid.
Absent: Adam Fischer and Doc Simont
Chairman Hedden called the meeting to order at 8:00 PM in the Cornwall Town Hall with a quorum established. Mr. Kane was seated for regular member Doc Simont and Mr. MacDavid for regular member Adam Fischer.
APPROVAL OF MINUTES: August regular meeting.
Motion Mr. Kane, second Mr. MacDavid to approve the minutes with corrections as reflected in the Cellco response, “With note made that candidate site 1 posed more potential impact” to “With note made that both of these proposed sites are adjacent to Poughkeepsie Turnpike”, unanimously approved.

PENDING APPLICATIONS:
App #529- Gary Bevans applicant/owner – Regulated activities for the installation of a culvert crossing within a brook for access to rear residential property and associated residential activities on same - 34 Hall Road. (Accepted at August meeting)
Mr. Bevans was in attendance to represent the application.
Referencing information made part of App. 346, granted on October 10, 2001 to the Estate of Bertha Pelletier, (34) Hall Road, expiration date October 10, 2006, staff read into and made part of the record the 11 conditions of the “34 Hall Road, Cornwall. Construction Procedure” as follows:
Contractor to obey and comply with the conditions and requirements of the Town of Cornwall.
Install and maintain sediment and erosion controls as per plan (made part of file by reference).
Clear area of work of trees, brush and undergrowth to allow for installation of pipe.
Strip and stockpile topsoil to allow for construction access from Hall Road.
Prepare stream bed with leveling course of ½” native gravel.
Install 25’ of 35” pipe HDPE corrugated Hi-Flo H-20 axle loaded P.V.C. pipe with flared end pieces and back fill with ½” gravel compact to one foot above top of pipe.
Install 4” to 6” Rip-rap at end’s of pipe two feet up stream and two down stream of piping.
Install and compact one foot of ¾” processed stone on construction fabric on top of ½” gravel.
Install four to six inches of topsoil on disturbed areas. Rake seed and hay mulch.
Floating silt boom to remain in place until disturbed areas are stabilized.
Temporary dike to be pumped down and removed with minimal disturbance to streambed and banks after pipe and rip-rap have been installed.
In response to questions, Mr. Bevans stated that he would be subcontracting the job out and that in conversations with several contractors quoting the job that the duration of time needed to do the job was 1 days worth of work. Mr. Bevans stated that he would grass and seed over parts of the access road (as shown on the previous plan from Hall Road to the brook crossing) as his intent was for the brook crossing to be used only for access to the rear of the property for maintenance, removal of junk, and firewood and not as a driveway or continuation of the existing driveway.
Based on Mr. Bevans’s verbal agreement that all components of the application previously approved would be complied with.
Motion Mr. Kane, second Mr. Hurlburt, to approve App #529- Gary Bevans applicant/owner – Regulated activities for the installation of a culvert crossing within a brook for access to rear residential property and associated residential activities on same - 34 Hall Road as presented, including the incorporation of the construction sequence and details of the crossing as provided for in App. 346, granted on October 10, 2001 to the Estate of Bertha Pelletier, (34) Hall Road, expiration date October 10, 2006 with the following additional conditions (as added by Mr. Hedden)
The Land Use office was to be notified prior to the start of construction.
The Land Use office was to be supplied with the name of the contractor prior to the start of construction.
All of the required materials as specified and equipment necessary to complete the job was on site prior to the start of construction and to be certified by the Land Use office.
Motion, with conditions accepted and added: unanimously approved.
INLAND WETLANDS OFFICER REPORT.
Griswold Nelson advised the commission that work was ongoing at the Furnace Brook Farms site (weather permitting) with the re-grading and clean-up of the final bench remaining to be done. It was noted that erosion and sedimentation controls were in place and with areas of re-vegetation and site stabilization in good shape.
Griswold Nelson advised the commission that work was ongoing at the DePolo/Dibble Hill site with the house underway and areas of the site disturbed for construction activities. The commission expressed concerns regarding the stabilization of the area under and around the structure with staff to follow up on the matter.
INFORMAL DISCUSSIONS:
Revisit Cellco pre-application information received proposing a telecommunication facility (one of two sites proposed) on Popple Swamp or Bell Road.
The commission addressed correspondence prepared by staff with recommendations for changes to the language as shown (to be reflected in the minutes of the August meeting) The commission addressed the consideration of intervener status based on the concerns by the commission as to potential impact to wetlands and watercourses on both sites with staff to follow up the matter.
CORRESPONDENCE AND COMMUNICATIONS RECEIVED.
The consideration of a special meeting to review changes to the regulations was discussed with a special meeting to be set up in October based on the agenda for the month.
Correspondence from the Connecticut Federation of Planning & Zoning Agencies (CFPZA) addressing exempt uses and the recent court finding that an application for any exempt activity must be filed before any activity takes place so that the commission is given the opportunity to determine if the proposed activities are exempt was addressed. It was noted that the Land Use office would be receiving an application from the Hollenbeck Club and that the CFPZA literature had been forwarded to the Hollenbeck Club in support of the commission’s request for a formal application.
