PLANNING & ZONING COMMISSION SPECIAL MEETING JUNE 23, 2009


Present: Regular members Anne Kosciusko (in 8:50PM), David Colbert, Pat Hare, Rick Lynn, Alternate Heidi Kearns, commission staff Karen Griswold Nelson and commission planning consultant Tom McGowan.

Absent: Regular members Lynn Cheney and Chris Hopkins and alternates Emily Pryor and James LaPorta.


Vice chairman Pat Hare called the meeting to order at 7:35PM. All members were seated for all of the proceedings. The order of business was changed to accommodate the arrival of chairman Anne Kosciusko.


PLAN OF CONSERVATION AND DEVELOPMENT WORKSHOP MEETING.

Copies of the June 23rd revised draft of the “Natural resources” section of the Plan of C&D were distributed for review and comment. The commission reviewed the draft with direction given to Mr. McGowan as to final additions, deletions and modifications prior to making the draft available for public review and comment. The commission discussed the “Housing” section of the plan with the section to be revisited at the next meeting.


PENDING APPLICATION:

App #704 - Cornwall Housing Corporation applicant - Re-subdivision of a 9+- acre parcel into 3 parcels (2 parcel program lots and 1 elderly housing lot in a combined zone parcel – R5 and GB – Assessors Map HO- 1 – Block 03-parcel 03 - Kent Road.

Prior to deliberations, commission members Pat Hare and Heidi Kearns reviewed the tape of the continued public hearing for the pending application at the June 9th regular meeting

The commission discussed and reviewed the pending application with issues raised as to the inability of the commission to correct the conflict regarding the correct definition of buildable area without a formal public hearing. Various scenarios were revisited, (with reference to correspondence from the applicant made part of the record), with input from Mr. McGowan as to the options open should the application be denied, noting that the regulations for “buildable area” could be challenged as to relevance to “health, safety and public welfare in court proceedings for affordable housing. Commission consensus was that the conflict needed to be addressed in a timely fashion outside of this application process.


Motion Mr. Hare, second Mr. Colbert, to approve App #704 - Cornwall Housing Corporation applicant - Re-subdivision of a 9+- acre parcel into 3 parcels - 2 lots approved as special exceptions as allowed in Section 8.26 “Town or Non-profit sponsored lots” and 1 lot approved as a special exception as allowed in Section 8.25 “Town or Non-profit sponsored affordable multi-family housing” in a combined zone parcel – R5 and GB – Assessors Map HO- 1 – Block 03 -parcel 03 - Kent Road. The subdivision with the special exceptions for the three lots was approved as per the oral and written testimony of the applicant and their representatives, a site plan submitted entitled “Proposed site development Plan – 3 lot subdivision – Kent Road and Dark Entry Road, Cornwall, CT prepared by Brian Neff, dated 2/28/2009 REVISED” and other correspondence regarding necessary approval for water supply and sanitary sewer. Motion approved Mrs. Kosciusko and Kearns and Mr.’s Hare and Colbert and Mr. Lynn voted in opposition, citing his reasoning relating to the existing conflict in the regulations.




Additional meetings for the preparation of the Plan of Conservation and Development and the desired timing to complete the process were discussed with meetings informally set for July and August.
